Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the ViaBuild platform and ViaSite application (the "Services"). This AUP is incorporated into and forms part of our Terms of Service.

1. General

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that all Authorised Users within your organisation comply with this AUP.

2. Prohibited Uses

You must not use the Services to:

2.1 Illegal Activity

  • Violate any applicable local, state, national or international law or regulation
  • Process, store or transmit information in breach of privacy, data protection or workplace safety laws
  • Facilitate money laundering, tax evasion, fraud or other financial crimes
  • Infringe the Intellectual Property Rights of any third party

2.2 Harmful Content

  • Upload, store or transmit viruses, malware, ransomware or other harmful code
  • Upload content that is defamatory, obscene, threatening, harassing or discriminatory
  • Upload content that exploits minors in any way

2.3 System Abuse

  • Attempt to gain unauthorised access to the Services, other accounts, or computer systems
  • Interfere with or disrupt the Services, servers, or networks
  • Circumvent any security measures, access controls, or usage limits
  • Use automated scripts, bots, crawlers or scrapers to access the Services (except via authorised APIs)
  • Engage in denial-of-service attacks or similar disruptive activities
  • Probe, scan or test the vulnerability of the Services without prior written authorisation

2.4 Commercial Misuse

  • Resell, redistribute or sublicense access to the Services to third parties
  • Use the Services to develop a competing product or service
  • Share login credentials between individuals
  • Exceed the number of Authorised Users included in your Subscription
  • Use the Services for benchmarking against competing products without prior written consent

2.5 Data Misuse

  • Upload data you do not have the right to process
  • Attempt to extract, scrape or mine data from the Services for purposes other than your authorised use
  • Attempt to re-identify Aggregated Data or de-identified data
  • Use the Services to build databases for sale to third parties (other than through your normal use for your construction business)

3. Resource Limits

We may set fair usage limits on storage, API calls, email processing, AI extractions and other resources. If your usage significantly exceeds normal patterns, we may contact you to discuss upgrading your Subscription or adjusting your usage.

4. Reporting Violations

If you become aware of any violation of this AUP, please report it to security@viabuild.au.

5. Enforcement

We may investigate any suspected violation of this AUP. If we determine that a violation has occurred, we may:

  • Issue a warning
  • Temporarily suspend access to the Services
  • Permanently terminate your Account
  • Remove or disable offending content
  • Report the violation to relevant authorities

We will endeavour to provide notice before taking enforcement action, except where immediate action is necessary to protect the Services, our users, or the public.

6. Changes

We may update this AUP from time to time. Material changes will be notified in accordance with our Terms of Service.
